HC restrains GU vice-chancellor Monday, June 25, 2001

AHMEDABAD, June 23: Justice P K Sarkar of the Gujarat High Court has restrained Gujarat University vice-chancellor from exercising executive council powers and stayed the granting of affiliation to new colleges.
A writ petition was moved by University Executive Council member Narhari Amin challenging the delegation of powers by members of the executive council in favour of the vice-chancellor, and the latter acting solely as the executive council and taking decisions on behalf of the council.
During the last meeting of the council, held on June 18, 2001, a resolution was passed to decide the need of new colleges to be given to different institutions in commerce, BBA and BCA. It also decided to grant colleges as per applications received from different institutions by the vice chancellor. For such purpose, the powers vested in the members of the council were given to the (officiating) vice-chancellor Chaitanya Khambholaja.
The petitioner objected that the powers which are vested under Section 33 of the Act to grant affiliation are with the members of the council, and such powers cannot be delegated since there is no provision in the Act for such delegation. And therefore, each application for granting new affiliation should be decided in the council meeting itself.
It was also argued that the powers and duties of the vice-chancellor stated in Section 11 of the Act did not include powers to grant affiliation.News Source : Times Of India News Service [ Lightning News ]
